On August 7, 2012, the United States Court of Appeals for the Second Circuit issued an opinion in favor of Clayman & Rosenberg’s client in VAM Check Cashing Corp v. Federal Insurance Company. The case involved a check cashing business victimized by fraud for which its insurer refused to provide indemnification. The Court of Appeals affirmed the lower court decision granting summary judgment to the plaintiff and awarding the plaintiff 100% of the damages sought.
